Transit Officer's powers
Authorised officers (Transit Officers and Inspectors) travel on Transperth bus, trains and ferries and are employed to ensure that passengers comply with ticketing and behavioural requirements.
The following information advises you of your rights and responsibilities when using Transperth.
What authority do Transperth officers have?
All inspectors and Transit Officers are empowered under the PTA Act and Regulations 2003 to issue infringements for fare evasion or any other actions which contravene the regulations. This includes: smoking on platforms, consuming food and drink and any inappropriate behaviour. Transit Officers also have powers of arrest.
What if I refuse to show my ticket?
Under the PTA Act, passengers are required to produce a ticket for inspection. Refusal to do so is breaking the law and further infringements can be issued. All inspectors and Transit Officers have the authority to:
- Ask passengers for their name and address
- Ask passengers to produce documents to verify that the information provided is correct
- Detain a passenger for the length of time it takes to obtain such information
- Detain a passenger who refuses to cooperate.
Note: Transit Officers and Inspectors perform ‘inspection blitzes’. Fare evasion is not tolerated on Transperth services.
Can I be arrested if I don’t co-operate?
Yes, additionally you may be escorted to a police station, or the police may be called to attend. If the matter is not resolved, it could proceed to the Magistrate’s or Children’s Court.
